A Florida woman is taking on The Hershey Company, claiming it has “defrauded” customers through “misleading” packaging on seasonal Reese’s chocolates.

Cynthia Kelly, of Tampa, is suing the chocolate giant for $5 million because she claims the packaging and actual contents don’t match.

For example, the pumpkin-shaped chocolates do not have cutouts for eyes and noses as the packaging suggests, and the footballs are egg-shaped, according to the lawsuit, filed in Florida’s Central District Court.

“Hershey’s labels for the Products are materially misleading and many consumers have been deceived and misled by the pictures on the Product’s packaging,” says the lawsuit, seen by The Post.

“This is a class action against Hershey for falsely representing certain Reese’s Peanut Butter products as containing an explicitly engraved artistic design when there is no such engraving on the actual product,” the suit says.

The strange claim came after Kelly bought a pumpkin-shaped candy at Aldi for $4.49, believing it “contains cute-looking carvings of pumpkin mouths and eyes as depicted on the product packaging.”

He said he would have left the chocolate if he had known the carved face wasn’t actually included on the snack-sized Reese’s.

“The Reese’s Peanut Butter Pumpkins products that Plaintiff purchased did not contain any artistic carvings of mouths or eyes as depicted on the labels,” the lawsuit reads.

The lawsuit features more than just pumpkin shapes, but also ghosts, bats, footballs, snowmen, and bell-shaped dishes, some of which are photographed in the suit.
