“Rust” actress Hannah Gutierrez-Reed filed to dismiss the charges against her following a new round of forensic tests on the gun used to kill cinematographer Halyna Hutchins and hospitalized director Joel Souza.
The “Rust” actor and actor Alec Baldwin were each charged with two counts of involuntary manslaughter in January 2023; however, the charges against Baldwin were dropped without prejudice in April shortly before they were to begin so that the two new special prosecutors would have more time to prepare their cases.
Although Gutierrez-Reed’s trial has been postponed until August, she hopes the judge will dismiss the claim entirely, following an allegedly “sloppy” law enforcement investigation into Hutchins’ death.

Attorneys for former “Rust” shield Hannah Gutierrez-Reed were in court Thursday to try to get two counts of involuntary manslaughter against her dismissed by a New Mexico judge (according to Deadline ). His legal team criticized the “sloppy investigation,” which at one point wrongly charged Baldwin and Gutierrez-Reed with gun enhancements that weren’t enacted into law until months after Hutchins was killed on set.
“They directed a sloppy investigation in which key evidence was destroyed, made overly aggressive charging decisions, including fundamental Constitutional errors, and conducted roadshows to disparage Reed and promote their own personal brand,” lawyers for Gutierrez-Reed wrote in court. filing, which can be read in full here.

In the thirty-three-page report, attorneys Jason Bowles and Todd Bullion wrote, “Because this prosecution is motivated by personal interest – not fact or law – it was formed with the goal of taking place in the court of public opinion, not a jury trial.” They went on to say, “As a result, corners were cut and the prosecution team committed other due process and ethical violations.”
Former armor “Rust’ has pleaded not guilty to two counts of involuntary manslaughter. If convicted, he faces a maximum sentence of eighteen months in prison and a fine of about $5,000… if the case goes to a jury. A preliminary hearing, to determine whether the trial will continue or not, has been adjourned until August.
Gun Used In Shooting Was Reportedly Damaged By FBI Test

Part of the alleged “sloppy investigation” stems from the gun used in the shooting. According to his legal team, the firearm was damaged as a result of FBI tests the weapon underwent when the FBI stepped in to help investigate the high-profile case.
“After repeatedly striking the firearm with a rawhide mallet, the internal components of the firearm ruptured,” Bowles and Bullion explained in the court filing. “This lack of material evidence is detrimental to Reed. Mr. Baldwin’s charges have now been dismissed, on the grounds that the firearm was ‘modified,’ and that the FBI’s destruction of the charred makes a definitive determination now impossible or nearly impossible.”

The Santa Fe District Attorney backed down to allow the hiring of two new special prosecutors, Kari Morrissey and Jason Lewis, but they dropped the charges against the Emmy award-winning actor just weeks after they joined the case. However, they warned that charges “may be refiled” as they continue their investigation.
“Over the past few days and in preparation for a preliminary hearing on May 3, 2023, new facts have come to light that demand further investigation and forensic analysis in the case against Alexander ‘Alec’ Rae Baldwin, III,” they wrote in a statement in April.

“Therefore, we cannot proceed under the current time constraints and based on the facts and evidence submitted by law enforcement in its current form. Therefore, we will dismiss the involuntary manslaughter charge against Mr. Baldwin for further investigation,” they continued. “This decision does not absolve Mr. Baldwin of criminal wrongdoing and charges can be filed again. Our follow-up investigation will remain active and ongoing.”
There is fresh speculation that the reason charges were brought against the actor was that the firearm in question had been modified and could explode without the actor pulling the trigger. Baldwin has insisted that he never pulled the trigger, even in an interview with ABC just weeks after Hutchins’ death.
