Last month a planned plea deal for Hunter Biden on two federal misdemeanor counts of willfully failing to pay federal income taxes imploded in a Delaware court.
The agreement was supplemented by a pretrial diversion agreement on a felony firearm charge for unlawful possession of a firearm while under the influence of an illegal drug.
US District Judge Maryellen Noreika, a Trump appointee who oversaw the trial, raised constitutional questions about the deal and found a compromise between the prosecution and the defense.

The younger Biden’s lawyer appears to be under the impression he will be spared other potential charges as the federal government continues its investigation, believed to be related to his foreign activities.
On August 11, US General Merrick Garland granted Delaware US Attorney David Weiss — a key figure in the Hunter Biden case — special counsel authority. As a result, Weiss has now added legal firepower to his investigation.
Complimenting the investigation is an effort by congressional Republicans, led by Oversight Committee Chairman James Comer (R-Ky.) to delve into the Biden family’s overseas activities and potential influence peddling.

The White House has accused the GOP of tampering with Hunter Biden’s record and his top lawyer, Abbe Lowell, strongly believes his client should not face additional charges.
“No new evidence has been found,” he told CBS’ “Face the Nation” earlier this month, insisting that if prosecutors stick to “the facts, the evidence and the law,” there will be no new charges.
