James Comer defends not subpoenaing Hunter Biden yet: ‘It’s very difficult’

House Oversight Committee Chairman James Comer said his panel has not subpoenaed Hunter Biden yet because of the legal complexities of going after members of the president’s family.

“He can fight the subpoena in court. It is very difficult. I think if it’s easy to get the president or their son in front of a House committee, the Jan. 6 committee will probably do it with Donald Trump,” Comer (R-Ky.) told Newsmax.

Finally, the Jan. 6 committee actually subpoenaed former President Trump to testify.

Just before the 2022 midterm elections, the panel slapped him with a subpoena demanding testimony by mid-November of that year, but the former president refused.

The Comer panel has launched subpoenas aimed at obtaining financial and other records related to the first son in recent months.

But the powerful Comer Oversight Committee did not subpoena testimony from the man himself.

“Hunter Biden is very welcome to come to the committee,” Comer added. “If he wants to clear his name, if he wants to come and say, ‘You know, these are 20 shell companies, they’re actually doing things,’ he’s invited.”

The Oversight Committee has relied on voluntary cooperation from witnesses such as Hunter Biden’s longtime business partner, Devon Archer, who testified in July.

Notably, the January 6 committee also subpoenaed individuals very close to the Trump family such as Kimberly Guilfoyle, Donald Trump Jr.’s fiancee.

At one point, it issued a subpoena for Eric Trump’s records.

Although the Jan. 6 committee heard from some of former President Trump’s children like Ivanka Trump in person, it did so through voluntary appearances.

On Tuesday, Speaker Kevin McCarthy (R-Calif.) announced that he is ordering an impeachment inquiry into President Biden over alleged ties to his family’s business dealings.

As part of the pledge, Comer Judiciary Committee Chairman Jim Jordan (R-Ohio) and Ways and Means Chairman Jason Smith (R-Mo.) will take note.

McCarthy’s action comes after he previously vowed to hold a floor vote on whether to initiate an investigation. After a handful of Republicans balked, perhaps indicating the motion would fail, he did so unilaterally.

The speaker defended the move, arguing that he was simply following the precedent set by his predecessor, former Speaker Nancy Pelosi (D-Calif.).

Pelosi unilaterally initiated an impeachment inquiry into Trump in 2019 to look into alleged quid pro quo deals with Ukraine.

The Trump administration’s Justice Department later concluded that its lack of an official vote invalidated the investigation — an opinion Biden’s DOJ could hold. Pelosi then called the official vote.

With the impeachment inquiry, congressional Republicans will enjoy greater power to investigate the Biden family.

Biden’s allies condemned the move.

“House Republicans have been investigating the President for 9 months, and they have shown no evidence of wrongdoing. His own GOP members have said so. He vowed to hold a vote to open impeachment, now he is flip flopping because he has no support. Extreme politics at its worst,” White House spokesman Ian Sams posted on X (formerly known as Twitter).
