According to legal documents obtained by The Blast, the “Keeping Up With The Kardashians” alum and a disgruntled fan have settled an alleged invasion of privacy claim.

Earlier in January, Kardashian’s shapewear company was accused of using spyware to monitor the activities of its website users.

A California customer, Miltita Casillas, filed the lawsuit, claiming the brand has “caused economic injury and intangible injury.”

However, he changed his tune three months later, and a new legal document states that he has settled his dispute with the SKIMS company.

It is unclear whether the parties concluded the case with monetary compensation, but the filing emphasized that the settlement was unconditional.

Thanks to their agreement, the lawsuit against the Kardashian brand will be dismissed within 45 days of the settlement date — April 5, 2024. No further hearing is scheduled; however, there will be a case management conference on May 6 at 8:30 am.

In Alleged Invasion of Privacy Claims

As mentioned, Kardashian’s company SKIMS has been accused of violating its customers’ privacy by a female user from California. The plaintiff describes himself as a “consumer privacy advocate who works as a tester.”

In her lawsuit, she accused SKIMS of secretly accessing her device after she visited the site in 2023. She claims the shapewear brand monetized her knowledge of visitor activity, allegedly obtained through tracking software.

The alleged tracking devices include “pen register” and/or “trap and trace” spyware, commonly known as “PR/TT Spyware.” The document reads:

“Defendant has embedded at least one PR/TT beacon on its website to capture electronic impulses originating from the site to identify the source of the communication, including the identity and geolocation of each website visitor.”

It continued: “PR/TT beacons on the Defendant’s website use various signaling mechanisms to trap and track its users; they monitor user activity (such as page views, searches or purchases), decode the device used by each website visitor, and help identify location, race, age and ethnicity of each user.”

An aggrieved SKIMS customer stated that she believes the shapewear brand “generates at least eight percent of its revenue from its website,” which she claims is aided by the invasion of her customers’ privacy.

Additionally, he believes his case has merit because “the privacy of personal information is and always has been a legally protected interest in many contexts.”

Thus, SKIMS’s alleged invasion of privacy has “caused economic injury and intangible injury.”

At the time, Kardashian did not respond to the lawsuit, but it is important to note that she was not sued along with SKIMS.
