As for the lawsuit against him, court documents obtained by The Blast show that Powers and Stone have essentially refiled their old case as a new lawsuit and are seeking $20 million in damages. The papers read:
“The melody, the lyrics, the feeling, when you combine these three elements and base your derivative copy on something more like than unlike, it is the striking similarity that upon closer inspection will reveal the truth of Plaintiff’s alleged infringement.”
The filing goes on to declare that “Carey has, without licensing, abandoned these works with his disbelieving original story, as if the works were his own. His arrogance knows no bounds, and even the songwriters he’s credited with don’t believe the stories he’s spun. This is only a case of actionable infringement.”
In their previous lawsuit, which Stone dropped in November 2022, it was alleged that Carey and her co-writer for the song, Walter Afanasieff, “knowingly, knowingly, and willfully” infringed the copyright of the musician’s 1989 rendition of “All I Want” to Christmas Is You,” which he recorded under the name Vince Vance and the Valiants.
He went on to point out that his version received significant airplay during the 1993 Christmas season and began appearing on the Billboard Music Charts. Stone also mentioned that his attempts to negotiate and reach an agreement with the “Obsess” hitmaker and his co-defendants in April 2021 were unsuccessful.
