The lawsuit in question was filed by Andy Stone and Troy Powers, who previously sued the singer over alleged infringement. According to court documents obtained by The Blast, the two claim:

Taking it a step further, the document asserts that Carey, without obtaining the necessary license, has presented this work as if it were his own, accompanied by “an incredulous origin story.” He added, “His arrogance knows no bounds, even the songwriters credited with him don’t believe the story he has spun. This is only a case of actionable infringement.”

Stone and Powers is seeking a temporary injunction to stop or limit copyright infringement and unauthorized use of their exclusive proprietary rights. They also demand the seizure of all copies of the allegedly infringing work, a permanent injunction to prevent any future infringement or misappropriation, and damages totaling $20 million.

In the initial filing, made in June 2022, Stone alleged that Carey and her co-writer, Walter Afanasieff, had “knowingly, knowingly, and willfully” infringed the copyright of her 1989 song, “All I Want for Christmas Is You,” which had he recorded under his musical name, Vince Vance and the Valiants.

The rock and roll performer detailed that his version of the song recorded “extensive airplay” during the 1993 Christmas season and also appeared on the Billboard Music Charts. He also revealed that his attempts to negotiate and reach an agreement with the award-winning singer and his co-defendant in April 2021 were fruitless.

The musician, who is also represented by Andrew John Franichevich Jr., identified himself as a self-employed artist in the document. He explained that he earns his living by selling, performing and licensing his copyrighted music.
