Missouri Secretary of State Jay Ashcroft is threatening to remove President Biden from the electoral ballot as other states seek to disqualify former President Trump from seeking a second term over his actions during the January 6, 2021 US Capitol riots.
The US Supreme Court is expected to rule on whether Trump can appear on the Republican primary ballot in Colorado after the state Supreme Court ruled he could not, citing the rebellion clause of the 14th Amendment.
The high court sided with a lower court that ruled Trump incited his supporters when Congress certified Biden’s 2020 election victory. The Colorado Supreme Court decision is the first time in history that Section 3 of the 14th Amendment has been used to bar a presidential challenger from the ballot.
Maine’s secretary of state ruled Trump should be removed from the ballot for the same reason. Trump appealed the decision.
On Friday, Ashcroft, a Republican, said the efforts in Colorado and Maine were “disgraceful” and “undermining our republic.”

“While I expect the Supreme Court to overturn this, if not, the Secretary of State will step in & make sure the new legal standards for @realDonaldTrump apply equally to @JoeBiden !,” Ashcroft wrote on X.
“I am not in favor of going this way. But if we’re going to go down this road, it’s inevitable, if the Supreme Court doesn’t stop this,” Ashcroft told St. Louis Post-Dispatch. “The rules will be applied equally. I just hope it won’t be Colorado and Maine’s rule.
Republicans have sharply criticized Democrats for trying to remove Trump from the 2024 presidential election ballot, saying it undermines the will of voters.

Last month, Texas Lieutenant Governor Dan Patrick suggested that Biden be removed over his handling of the southern border.
“Seeing what’s happening in Colorado tonight … makes me think — unless we believe in democracy in Texas — maybe we should get rid of Joe Biden in Texas for allowing 8 million people to cross the border since he became president, disrupting our state even further. than anything anyone else has done in recent history,” Patrick said in an interview with Fox News’ Laura Ingraham on “The Ingraham Angle.”
In letters submitted to the high court, more than a dozen states signaled their support for Trump, including Missouri.
