First assistant director Dave Halls, who pleaded guilty to a charge of negligent use of a deadly weapon, will appear in court later this month along with Baldwin and Gutierrez-Reed.
Although Baldwin was spotted out and about playing poker with his wife, Hilaria Baldwin, on the day he was formally charged, Gutierrez-Reed’s attorney, Jason Bowles, has spoken out in his defense.

After the charges were first announced on January 19, “Rust’s” defense attorney, Jason Bowles, released a statement, saying, “Hannah was, and always has been, very emotional and saddened about this tragic accident. But she did not commit involuntary manslaughter.”
“These allegations are the result of a deeply flawed investigation, and an inaccurate understanding of the full facts,” Bowles added. “We intend to reveal the full truth and believe Hannah will be acquitted by a jury.”

Earlier this week, Bowles appeared on TMZ Live, where he shared some more details about the fatal shooting. Bowles said that Gutierrez-Reed asked first assistant director Dave Halls to tell her when Alec Baldwin would be handling the gun so she could expect it the day Halyna Hutchins was shot.
He also reportedly wanted to give Baldwin proper instructions on how to handle the gun before they rehearsed the scene in the church, where the fatal shooting took place.

However, Bowles said that Halls never told Gutierrez-Reed that the shooting was going to happen. Instead, the “Rust” shield contends that Halls, who pleaded guilty, handed the gun to Baldwin without following proper safety procedures.
If that wasn’t enough, Bowles said that Hannah was “extremely thin” on set and had several tasks that conflicted with her ability to properly supervise the weaponry. Apparently, his work between being a shield and handling props became so complicated that he actually sent an email to the production team to tell them that he needed to step back from props to focus on his duties as a shield. According to Bowles, the production team reportedly rejected his request.
Director Joel Souza Also Puts the Blame on First Assistant Director Dave Halls

In the 551-page police report, director Joel Souza also pointed the finger at first assistant director Dave Halls for failing to follow proper gun safety procedures on set. He told police that on October 21, the day Halyna Hutchins was fatally shot, that Dave had announced it was a “cold gun” before the crew broke for lunch.
However, it appears that Souza also directed some blame at Baldwin, as he argued that the script did not require him actually holding a gun for the scene.

According to the police report: “Joel explained that the shooting required Alec to slowly pull the gun out and partially remove it from the holster. When asked if the shooting required Alec to fully remove the weapon and point it, Joel stated ‘no’ because they didn’t get that far.”
Souza was standing directly behind Hutchins when the gun was fired. According to the medical examiner’s report, Baldwin “raised a firearm at the camera as part of a rehearsal, which then discharged and struck Ms. Hutchins, as well as the director, who was reportedly standing behind Ms. Hutchins. The bullet was later recovered from the director at a hospital.”

On Thursday, December 2, 2021, ABC News aired an exclusive interview between the “30 Rock” cast and news anchor George Stephanopoulos. During the interview, Stephanopoulos stated, “It wasn’t in the script for the trigger to be pulled.”
“Well, the trigger wasn’t pulled,” Baldwin replied. “I didn’t pull the trigger.” Baldwin insisted, “I would never point a gun at anybody and pull the trigger on them, never.”

When asked how a live bullet ended up on a movie set, Baldwin replied, “I don’t know. Someone put a live bullet in a gun. A bullet that wasn’t supposed to hit the property.”
None of the other “Rust” producers were criminally charged in the shooting.
