Actor Alec Baldwin is still trying to get his “Rust” criminal trial thrown out before its scheduled start date of July 9.
The “30 Rock” actor is facing involuntary manslaughter charges in connection with the death of cinematographer Halyna Hutchins. He faces up to 18 months in prison and a fine of up to $5,000 if convicted.

‘Rusty’ Prosecutor Slams Alec Baldwin’s Attempt To Get Trial Thrown Out

Last month, Alec Baldwin’s attorney filed a tentative motion to have the case dismissed before it went to trial. He and shield Hannah Gutierrez-Reed were both indicted on two counts of involuntary manslaughter in January 2023. However, the charges were dropped without prejudice in April 2023, pending further investigation into the gun Baldwin was holding set for October 21, 2021.
After a forensic examination conducted by the FBI concluded that Baldwin had to pull the trigger for the gun to go off, something the actor vehemently denied, the charges were refiled in January 2024. In addition to pleading not guilty, his attorney called the refiling alleging “abuse of the system , and the abuse of innocent people” as they tried to get the judge to dismiss the charges.

Prosecutor ‘Rust’ Wants to Continue the Trial

In response to the motion to drop the charges, lead prosecutor Kari Morrissey wrote, “To see Mr. Baldwin’s behavior on the set of Rust is to witness a man who has absolutely no control over his own emotions and absolutely no concern for how his behavior affects the people around him.”
He also slammed the “false narrative” he accused Baldwin of building since the day Halyna Hutchins died, adding, “Witnesses have testified that it was precisely this behavior that contributed to the security compromise on set.” He was referring to the witness who testified against Hannah Gutierrez-Reed’s shield, which found her guilty of involuntary manslaughter but acquitted her of a lesser charge of tampering with evidence.

Alec Baldwin’s Plea Agreement Withdrawn

In the last court filing, the public learned that Alec Baldwin was actually offered a plea deal in October 2023, months before the charges were refiled. However, the offer was withdrawn before he and his legal team could accept or reject it.
In Morrissey’s latest 32-page filing, he uses language similar to the plea agreement received by “Rust” first assistant director David Halls, who has been charged with negligent use of a firearm. In this filing, Morrissey wrote:

“As this information is troubling, the undersigned’s counsel is not inclined to rescind the plea offer simply because Mr. Baldwin intends to continue to use the media to escape the consequences of his actions and his counsel has blatantly disregarded the privileged and confidential nature of the plea negotiations. Further, the undersigned attorney received information that Mr. Baldwin was commissioning his own documentary about the death of the woman he killed and was actively pressuring material witnesses in the case against him to submit interviews for his documentary. It was at this point that the plea offer was revoked, and the case was scheduled for a grand jury . And still Mr. Baldwin complains to this Court that he has been unfairly treated.”

‘Rusty’ Prosecutor Accuses Alec Baldwin of ‘Misrepresentation of Facts’

Morrissey went on to call “the motion to dismiss Baldwin is a predictably false, misleading, and historic misrepresentation of the facts and historical circumstances of the case,” going on to say that “the two special prosecutors who have been assigned to the prosecution of Mr. Baldwin have suffered almost countless lies and manipulation from the defense for more than a year.”
The filing also names all eight of Baldwin’s attorneys: “Heather LeBlanc (local counsel who, despite her reputation for hard work and efficiency, has been relegated to largely menial duties), Alex Spiro (New York), Luke Nikas (New York). York), John Bash (Texas), Sara Clark (Texas), Michael Nosanchuk (New York) Jennifer Stern (New York) and Stephanie Kelemen (New York).”
Prosecutors Continue to Get Justice for Halyna Hutchins

Morrissey goes on to say that the prosecution’s role is “to ensure that the case is not tried on its merits, and if it is tried on its merits, to discredit the prosecution, the investigation, and the witnesses in the media so that a conviction becomes impossible for reasons that had nothing to do with Mr. Baldwin’s criminal wrongdoing.”
The filing went on to say, “It is the duty of the special prosecutor to investigate the case and prosecute the case fairly and impartially and we will continue to do so despite the defendant’s relentless attempts to defame and intimidate the prosecution and witnesses- brave witnesses who continue to take part in the fight for justice for Halyna Hutchins and her family.”
