“COMING NOW the State of New Mexico, by and through special prosecutors Kari T.Morrissey and Jason J. Lewis, and enter a nolle prosequi in the causes numbered and styled above, because new facts have come to light which warrant further investigation and forensic analysis which are not can be settled before May 3, 2023, preliminary hearing. The case was dismissed without prejudice and the investigation is active and ongoing.”

However, the “30 Rock” actor is not yet in the free and clear. The charges were dismissed without prejudice, meaning that Baldwin could potentially face charges in the future as they investigate the fatal shooting of cinematographer Halyna Hutchins.

On Thursday night, they released a statement explaining that they could not prosecute Baldwin given the time constraints of the May 3 deadline. A statement (via Deadline) from two “Rust” prosecutors read:

“Over the past few days and in preparation for the preliminary hearing on May 3, 2023, new facts have come to light that demand further investigation and forensic analysis in the case against Alexander ‘Alec’ Rae Baldwin, III. As a result, we cannot proceed under the current time constraints and based on the facts and evidence submitted by law enforcement as they stand. Therefore, we will dismiss the charge of involuntary manslaughter against Mr. Baldwin for further investigation. This decision does not absolve Mr. Baldwin of criminal wrongdoing and charges can be refiled. Our follow-up investigation will remain active and ongoing.”

They also clarified that charges were not dropped against Hannah Gutierrez-Reed’s “Rust” shield, saying, “The charges against Hannah Gutierrez-Reed remain unchanged.”

Gutierrez-Reed’s attorneys, Jason Bowles and Todd Bullion, said, “The new special prosecutor team has taken a very diligent and thorough approach to the entire investigation, which we welcome and always welcome.”

In February, both Alec Baldwin and Hannah Gutierrez-Reed pleaded not guilty to two counts of involuntary manslaughter for the October 2021 shooting of Halyna Hutchins. A month earlier, first aid director David Halls had pleaded guilty to a charge of negligent use of a deadly weapon .
