Sam Bankman-Fried on Tuesday lost a bid to be released from prison so he can better prepare for his Oct. 3 trial. on fraud charges stemming from the collapse of its FTX cryptocurrency exchange, court filings show.
Bankman-Fried has said the conditions of his confinement at the Brooklyn Metropolitan Detention Center have made it impossible for him to adequately review prosecutors’ evidence against him and help his attorney build his defense case.
But US District Judge Lewis Kaplan in Manhattan said in a written decision that Bankman-Fried did not specify evidence to which she did not have access. He also said Bankman-Fried did not request a stay of probation, although Kaplan offered to consider such a request.
Kaplan said he would consider a more detailed request later for release.
Kaplan jailed the 31-year-old former billionaire on Aug. 11 after finding he may have tampered with witnesses at least twice, including by sharing the private writings of Bankman-Fried’s former romantic partner and colleague Caroline Ellison with a New York Times reporter.

Ellison, the former chief executive of hedge fund Alameda Research Bankman-Fried, has pleaded guilty to fraud charges in connection with the collapse of FTX and Alameda in November 2022 and is expected to testify against him at trial.
Bankman-Fried has said she shared the documents to protect her reputation, not to scare Ellison. He has separately appealed Kaplan’s detention order. A three-judge panel from the 2nd US Circuit Court of Appeals is expected to hear arguments in the case on September 19.

Federal prosecutors in Manhattan say Bankman-Fried stole billions of dollars in FTX client funds to cover losses in Alameda, buy real estate and donate to political campaigns in an effort to burnish her influence in Washington.
Bankman-Fried has pleaded not guilty. He has admitted to inadequate risk management at FTX, but denies stealing funds.
