In court documents obtained by PEOPLE, the former talk show host wants an emergency custody modification hearing, arguing that their son is suffering from “neglect.” The actress is seeking temporary physical custody of their then nine-year-old son, with Shepherd not receiving visitation until a judge makes a decision at the hearing.

She claimed their son – who was living in New Jersey with his mother at the time – read at a second-grade level, had trouble writing and tying his shoes, and had poor hygiene.

The “King of the Open Mics” actor also stated in his custody documents that his ex-wife’s busy work schedule prevented her from providing Jeffrey “the nurturing and loving environment, and care that Jeffrey so desperately needs.” Shepherd was granted custody of their child following a ruling issued in the summer of 2014.

Shepherd faced more legal drama when her second ex-husband, Lamar Sally, sued her for more child support for their two-year-old son, Lamar Jr. Although the little boy was not biologically related to Shepherd, she agreed to welcome the baby through a surrogate — using Sally’s sperm and an egg donor — and share him with Sally.

By the time their marriage began to fall apart, the surrogate was already pregnant. Before the boy was born, Sally and Shepherd had begun fighting in court over custody. And it didn’t stop when he arrived in 2015.
