Donald Trump is still expected in New York this week for his ongoing $250 million civil fraud trial – even though his confidant-turned-critic Michael Cohen is delaying his expected testimony in the case.
One of the former president’s lawyers hinted that Trump, 77, is still scheduled to appear Tuesday in a lower Manhattan courtroom — as the third week of his client’s trial begins Monday morning, according to a report by ABC News.
Manhattan Supreme Court Justice Arthur Engoron said he would set the week’s schedule — which is “quite unclear” — later today and acknowledged Trump’s expected return to the courtroom, joking that for now, lawyers will have to argue for empty seats.
“It’s not going to be empty tomorrow,” Trump lawyer Christopher Kise quipped in response, according to the report.
The former president’s appearance is expected to coincide with testimony from Cohen — his personal lawyer and “fixer.”

But Cohen — who was originally expected to take the stand Tuesday — said Friday he had to postpone due to medical conditions, ABC News reported.
“Unfortunately, I have to treat an existing medical condition that prevents my ability to testify this coming week,” Cohen said on X Friday.
“I don’t bow down. I am not afraid to testify. I am not paid. I have a medical problem that I need to take care of. It’s that simple,” he then added.

Cohen – who is a key witness in New York Attorney General Letitia James’ case against Trump – told ABC he was looking forward to testifying and correcting the record on various misrepresentations and answers by previous witnesses.
Trump appeared for the first three days of the hearing two weeks ago where protesters showed up in force and even blocked the street outside the courthouse.
The 2024 GOP front-runner took every opportunity in front of the press cameras to blast the case, the AG, the judge and even the judge’s clerk — prompting Engoron to hit Trump with a half-spoken order.
The former commander in chief and his three children, Ivanka, Eric and Donald Trump Jr. all are also listed on the AG’s witness list and could testify later in the trial – which is expected to last until December.
