A luxury Upper East Side hotel repeatedly served alcohol to minors to offset heavy losses during the outbreak, an explosive court filing claims.
And a video provided by the father of a teenager purportedly shows his 16-year-old son “very drunk” at The Mark Hotel.
Theodore Weintraub, now 19, claims The Mark on East 77th Street preyed on teenagers like him in an effort to fend off robberies.
“The Mark engaged in a scheme to prioritize revenue collection by serving alcohol to minors,” Weintraub’s attorney Leo Esses wrote in the counterclaim, filed last month in Manhattan Supreme Court.
The five-star hotel – a celebrity favorite including Meghan Markle and Gigi Hadid – has become known among Upper East Side teenagers as a place to seek service because staff “either failed to verify” their age or “ignored” fake IDs, the filing alleges.

“It is a known fact to Theo and his friends that Mark’s Restaurant is a good place to get alcoholic beverages as long as one has a ‘fake’ ID,” his father, Park Avenue cardiologist Dr. Philip Weintraub, told The Post.
The teenager was first sued by The Mark in July, accused of starting a smear campaign against the luxury hotel after he was banned for repeatedly trying to order alcohol.
The complaint alleges Weintraub hired protesters to chant and hold signs outside the hotel claiming The Mark denied the Holocaust and supported convicted pedophile Jeffrey Epstein.

The teenager also encountered guests and employees, according to a motion filed Monday on behalf of the hotel seeking to dismiss Weintraub’s counterclaim.
“The latest change in the Defendant’s problematic behavior is to try to defend his conduct by throwing more smears at his victims,” attorney Alexander Klein wrote in the new motion, which denies Weintraub’s accusations that The Mark targets underage drinkers.
Dr. Weintraub provided The Post with a nine-second video showing, he claims, his then-16-year-old son at The Mark restaurant “looking, outrageous, drunk” and playing with food.

An unfinished Champagne cocktail, said to be the hotel’s signature drink, is nearby.
“Based on this video, it should be a clear indication to any and all waiters and managers at the restaurant that he is behaving inappropriately: a baby-faced drunkard … ,” said Dr. Weintraub.
The hotel’s lawsuit alleges that the teenager was barred from the premises because he was upset about not being served alcohol — and his parents found out when the family showed up for dinner in September 2021 and the boy was barred from entering, prompting him to begin “accusing the hotel of being antisemitic and spitting out people’s food.”

However, Dr. Weintraub now says the story is different.

“The truth … is that Theo wasn’t banned from Mark’s because he was angry that they wouldn’t give him alcohol, he was banned on a boozy night at Mark’s which led to an argument with their security guard,” the father claimed.
Dr. Weintraub added that his son has been unconscious since January 7, 2023, but “what is most upsetting and disgusting is the amount of hate mail and hate phone calls that Theo and our family have to endure every day.”
One message mocked Weintraub as a “Zionist scoundrel” while threatening retaliation for his alleged actions.

“I hope The Mark sues your fat ass and you go to jail, you bigot!” notes obtained by The Post read. “Make sure you bring lube + condoms when you’re Bubba’s bitch + he makes you like-!”
Weintraub, who is seeking unspecified damages in his counterclaim, could not be reached for comment.
Klein, who represents The Mark Hotel, declined to comment.
