According to a legal document obtained by Explosion the alleged victim, identified as Chase Gardella, is suing both the YouTuber and his security for battery, assault, negligence and emotional distress.

According to court documents filed by the alleged victim, Doherty, and his bodyguard, King Kongg, real name Justin Goslee, the incident occurred on October 29, 2023, at a Halloween party.
Gardella claims Doherty and Goslee were chatting outside the house where the party was taking place, when Goslee asked the YouTuber, “What are we doing,” and Doherty replied, “We’re going to fight. It’s both of you, let’s go.”
Doherty allegedly signaled to Gardella and his friend, and “a moment later, Goslee violently punched him [Gardella] in the face, causing him to fall to the ground and causing serious physical injuries to his head, face and neck.”
YouTubers live-streamed the attack on Gardella on Kick, a live streaming platform, and even shared videos of the shocking incident on other social media platforms, such as YouTube, X and TikTok.
The lawsuit alleges that Doherty is still making money from the views generated by the gruesome video, all to the “detriment” of Gardella.
In the legal filing, it was revealed that Doherty had a “history” of recording himself “harassing,” “assaulting” and “assaulting members of the public” by having his bodyguards intimidate them and then continuing to assault them if they responded.
Now, Gardella is suing for assault, battery, negligence, negligent hiring and intentional infliction of emotional distress.
Doherty has yet to respond to the lawsuit.
