Former President Donald Trump promoted a conspiracy theory on Tuesday that accused his Republican rival, former South Carolina Gov. Nikki Haley, of not being elected president because her parents were not US citizens when she was born.
Trump, 77, shared false claims about his friend as a GOP presidential candidate when he posted a Gateway Pundit article to his Truth Social platform.
“In Nikki Haley’s situation, reports indicate that her parents were not US citizens at the time of her birth in 1972,” the far-right website said.
“Based on the Constitution as interpreted by @Paulingrasia, this disqualifies Haley from running for president or vice president under the 12th Amendment.”
The “legal scholar” mentioned in the article is a 2022 graduate of Cornell Law School.
The 12th Amendment laid out the procedure for electing the president and vice president and made no mention of qualifications.

Experts quickly refuted claims that the 51-year-old former ambassador to the United Nations was unfit to hold the nation’s highest office, noting that the 14th Amendment clearly states that “all persons born or naturalized in the United States” are citizens . .
“Having been born in South Carolina, he was clearly a ‘natural born citizen,’ regardless of the fact that his parents were immigrants,” said Geoffrey Stone, a University of Chicago professor who specializes in constitutional law.
Stone ripped the allegations as “silly” and argued there is no valid case that would disqualify Haley from the presidency based on her parents’ citizenship.

Haley – who was born in 1972 in Bamberg, SC – has repeatedly and proudly mentioned her parents’ immigrant history from India in campaign attempts.
Her father, Ajit Randhawa, became a US citizen six years after Haley’s birth in 1978, while her mother, Raj Randhawa, was naturalized in 2003, her office previously said.
Haley’s campaign did not immediately respond to The Post’s request for comment.

Tuesday was not the first time for Trump — whose paternal grandparents were German immigrants; whose mother immigrated from Scotland to the US as a teenager; and his current wife, Melania, born in Slovenia and moved to the US under a travel visa — have leaned into the birther claim about his rival.
The former commander in chief spent years suggesting that former President Barack Obama was born in Kenya rather than his native Hawaii.
Trump finally admitted during the 2016 White House campaign that Obama was “born in the United States, period.”

The 45th president has also fueled the conspiracy that Vice President Kamala Harris is not legally qualified to serve as vice president because her mother was born in India and her father is from Jamaica.
The latest criticism of Haley comes as a new poll shows her ahead of Trump in the New Hampshire primary race.
A CNN poll released Tuesday and conducted by the University of New Hampshire showed Haley trailing Trump by just seven percentage points among likely GOP voters in the Granite State.
