Madonna’s legal team has finally responded to two concertgoers who filed a lawsuit against her earlier this year over a delayed concert.
According to new documents, attorneys for the Queen of Pop and two other defendants named in the lawsuit — Live Nation and Barclays Center — filed a motion to have the case thrown out of court.

Madonna’s Lawyers Argue To Dismiss Concert Late Lawsuit

In a document filed on April 3 in the US Eastern District Court of New York, Madonna’s legal representatives argued that two male concertgoers, Michael Fellows and Jonathan Hadden, had no real case against the singer.
They dismissed their claims about the transportation issue as speculation and stated that it was not enough to claim compensation for the “Material Girl” hitmaker. His lawyer’s argument reads:
“Plaintiff speculates that ticket holders who leave the venue after 1 a.m. may have trouble getting a ride home or may have to get up early the next day for work. That is not a cognizable injury.”

Madonna’s legal team, per ET, went on to assert that a concertgoer’s demand to “get up early to go to work” is not a legal “injury” that one can claim. In addition, they criticized the claim that the concert was postponed as unreasonable.

Madonna’s Lawyer Hits Out on Delayed Concert Lawsuit

According to the singer’s lawyer, concertgoers cannot predict the start and end times of shows regardless of what is printed on event tickets. In their words:
“A reasonable concertgoer also knows that the length of a concert varies based on many factors.”
They also called out one of the plaintiffs, Jonathan Hadden, for singing a different song in his lawsuit after praising Madonna’s performance in Brooklyn. In a Facebook post dated December 14, 2023, he wrote:
“Caught the opening of her North American tour last night! A tribute to NYC! Amazing, as always! I never miss a Madonna Tour.”
“In other words, the concert met or exceeded her expectations,” the Queen of Pop’s lawyer stressed in the document.

The legal drama between Madonna and two concertgoers began in the middle of her Festival World Tour. In January, Hadden and Fellows sued the 65-year-old singer, claiming his Dec. 13 show in Brooklyn allegedly started two hours late.
He was slammed along with Live Nation and Barclays Center for “false advertising, negligent misrepresentation, and unfair and deceptive trade practices” in the lawsuit.
Disgruntled fans said their tickets had stated the concert would start at 8:30 p.m. However, Madonna was more than two hours late and arrived after 10:30 p.m. with no late notice from her or the performers.
As a result, spectators had to wait for hours and struggle with limited transport and increased fees after the show ended after 1am

Hadden and Fellows claimed Madonna’s tardiness was unfair to all concertgoers because she was allegedly late to another show.
Disgruntled Concertgoers Claim Compensation

Hadden and Fellows claim that if they had known Madonna would be late for the December concert, they would not have bought the tickets. They also argued that he and the other defendants would unfairly profit from the false advertising.
Aggrieved concertgoers are asking the court to address their grievances in a jury trial. As for their claim, they seek actual and consequential damages for Madonna’s actions in addition to any pre- and post-judgment interests permitted by law.
In addition, they asked the court to grant them any other compensation deemed necessary for their case. Surprisingly, this wasn’t the only issue that occurred during Madonna’s Festival Tour.

Fan Slams Madonna For Singing To A Concertgoer In A Wheelchair

Last month, the 65-year-old singer got on the internet’s bad side after a video of her performance at the Kia Forum in Los Angeles went viral. In the clip, he chooses a fan to sit while others cheer.
“What are you doing sitting there? What do you want to sit?” Madonna asked before realizing the other party was in a wheelchair. “Oh, OK. Politically incorrect. Sorry about that. I’m glad you’re here,” he quickly apologized.
Despite his apology, many condemned the singer’s actions. “Ma’am, there are 100 reasons why someone could sit down – and they’re all valid,” one argued, while another pointed out that Madonna “didn’t apologize well enough.”
“She’s too quick to judge but too slow to apologize? That apology doesn’t cut it for me,” a third declared, adding that Madonna “needs to do better than that.”
