Mom whose daughter was allegedly killed by migrant MS-13 member sues DHS for $100M

A heartbroken mother whose daughter was allegedly raped and killed by MS-13 youth gang members from El Salvador has filed a lawsuit against the federal government for playing “Russian roulette with our lives,” accusing agents of failing to stop the suspect at the border.

Tammy Nobles, the mother of 20-year-old Kayla Hamilton, argued in a $100 million lawsuit that both the Department of Homeland Security and the Department of Health and Human Services failed her daughter by allowing the unidentified immigrant into the country without verifying her identity.

Nobles and another grieving mother testified Thursday before a House panel conducting an impeachment inquiry into Alejandro Mayorkas, whom they accused of failing to enforce federal immigration laws.

“To me this is not a political issue, this is a security issue for everyone living in the United States,” he told the Homeland Security Committee.

“This could be anyone’s daughter. I don’t want any other parent to experience the nightmare I experienced. I am his voice now and I will fight with everything I have to tell his story and bring awareness to the issue at the border.”

Two days later he and his lawyer reiterated his claim in an interview with NewsNation as they announced their claim.

“No one at the border did their job and checked his background,” Nobles reportedly said.

If the feds had screened the suspect properly, they would have realized he was a gang member — disqualifying him from entering the United States, he claimed.

In that case, Bangsawan claimed, his daughter is still alive.

“I want everyone to know what’s happening at the border,” he said. “I didn’t know what happened before my daughter was brutally murdered and raped – but I do now.

“And I find that story very confusing, how no one at the border did their job and checked his background.

“All they had to do was make one phone call to El Salvador to find out that he was a member of the MS-13 gang on the list,” Nobles added.

Her daughter was raped and strangled to death in a Frederick, Maryland trailer on July 27, 2022, police said.

He lived with the suspect, who allegedly rented the trailer from another illegal immigrant.

Authorities were finally able to arrest him in January 2023 after comparing his DNA with evidence from the crime scene.

He is charged with first-degree murder, as well as rape and robbery, and is currently being held without bail ahead of his trial scheduled for June 28.

But Nobles and his lawyer, Brian Claypool, now say the teenager should not have been allowed into the country in the first place.

“We’re bringing this lawsuit because we’re tired of being held hostage in our own country,” Claypool told NewsNation. “We are tired of DHS playing Russian roulette with our lives [and] with Kayla’s life.

“That’s why we brought this case,” he said.

“We allege that two federal agencies failed Kayla… and failed everyone,” Claypool said, claiming, “This could happen anywhere to anyone.

“DHS just needs to be held accountable,” he continued.

“All they have to do is follow their own protocol – pick up a 16-year-old young man’s t-shift trying to enter the border [and] they will see gang related tattoos. And guess what? That would make him ineligible to enter the country.

“He should have been sent back at that time to El Salvador.”

Claypool went on to argue that “all they have to do is pick one up, make a phone call and guess what? On the list in El Salvador is this young man, because he was arrested in July 2020 for being involved in the illegal gang MS-13.

“He will be disqualified, again, [from] ever entered this country.”

Claypool also argued that the Department of Health and Human Services “is responsible for putting [the suspect] in a detention facility for a few days and then make a phone call and confirm that this young man has what’s called a confirmed sponsor — a relative, a known, confirmed relative.

“Even if DHS lets him in, he still can’t enter the US unless he goes to a known relative,” he explained. “Well, they blew it too.

“And they will pay the price, because he ran away, by the way, after going to this ‘alleged’ confirmed sponsor. And then it got worse, when [the suspect] over[ed] in this trailer home as roommates with the beautiful Kayla, who has been leased by another illegal immigrant.

“So we’re done with this,” Claypool said.

“The federal government has blood on its hands. They owe us a duty to protect Kayla and others in this country, and we will bring about change through this lawsuit.”

The Post has reached out to the Department of Homeland Security and the Department of Health and Human Services for comment.

Meanwhile, Republicans on the House Judiciary Committee have launched an investigation into Kayla’s rape and murder as they criticize the Biden administration’s open borders policy.

In a May report, the Committee concluded: “The Biden Administration’s open border policy has created vulnerabilities that foreign criminals and gang members are exploiting to the detriment of the American people.

“The sad fact is [Department of Homeland Security] Secretary [Alejandro] Mayorkas and the Biden Administration have failed to implement basic screening and vetting measures—such as checking with law enforcement officials in the alien’s home country—to ensure those entering the US are not dangerous criminals or members of known gangs.

“At the same time, they continue to tell the American people that illegal aliens found along the southwest border are adequately vetted.

“This callous disregard for the safety of the American people, in the name of expedited processing of aliens, resulted in the tragic and preventable murder of Kayla Hamilton.”
