Trump Georgia co-defendant Chesebro wants to sever case from Sidney Powell

Former Trump campaign lawyer Kenneth Chesebro asked Friday to have his trial in the Georgia election meddling case dismissed from co-defendant and former Trump lawyer friend Sidney Powell, arguing that there is “no correlation or overlap” between the allegations against them.

Chesebro claims that he has not “physically met” Powell nor exchanged phone calls, texts, emails or social media messages with him during the legal push to keep the 77-year-old in office after losing the 2020 election to Joe Biden , according to the filing court.

The filing downplayed Fulton County District Attorney Fani Willis’ claim that Chesebro was the “architect of the Trump voter scheme” and called the allegations against Powell “completely separate, and completely unrelated.”

“The allegations relating to Ms. Powell center around her alleged belief, and the allegations serve to further that belief, that the voting machines had erroneously tabulated votes. In fact, the bulk of the allegations related to Ms. Powell center around activities that took place in Coffee County, Georgia. Not only has Mr. Chesebro never been to Coffee County or anywhere even near it, he is not overtly or directly alleged to have anything to do with any of the Coffee County allegations,” defense attorney Scott Grubman wrote in a 6-page filing .

Chesebro and Powell both separately requested a speedy trial, citing the Peach State’s right to speedy proceedings, and have entered written not guilty pleas, waiving their in-person trials on seven felony charges, including violating Georgia’s anti-rape law.

The charge is the only one that Chesebro and Powell face in common.

Chesebro also faces two counts of conspiracy to commit forgery in the first degree; two counts of conspiracy to commit false statements and writings; one count of conspiracy to file false documents; and one count of conspiracy to impersonate a public official.

Powell faces two counts of conspiracy to commit election fraud; one count of conspiracy to commit computer theft; one count of conspiracy to commit computer hacking; one count of conspiracy to commit computer invasion of privacy; and one count of conspiracy to defraud the state.

Chesebro’s motion argued that if he were tried with Powell, “the State would try to join them together in an effort to convict Mr. Chesebro on a theory of ‘conspiracy’ or ‘RICO’ based on the conduct of co-defendants who had nothing to do with anything he was accused of.”

“The actions of Mr. Chesebro and Ms. Powell are like oil and water; completely separate and impossible to mix (into a conspiracy),” Grubman wrote.

Willis has asked Fulton County Superior Court Judge Scott McAfee to set an Oct. 23 trial date for all 19 defendants in the case.

Trump’s legal team asked McAfee on Thursday to separate the former president’s case from two campaign lawyers, arguing that the proposed speedy trial date would not give the former president’s lawyer enough time to prepare a defense against the 13 criminal charges against which he has been charged.
